- This chapter analyses a Brazilian public tournament called Inova Energia, aimed at incentivising innovative projects in the renewable energy, electricity network, and transport sectors. The chapter starts with a doctrinal analysis of the Inova Energia program in light of the provisions of the World Trade Organization's Agreement on Subsidies and Countervailing Measures (SCM Agreement). The chapter then explores the source of revenue of the program and the controversies involving the use of subsidies oriented to innovation. The analysis reveals a number of inconsistencies and concerns, including: (i) a subsidy shall be deemed to exist in relation to the non-refundable payments under the Inova Energia program; (ii) the program adopted a de facto condition of local content; (iii) there is lack of evidence that the destination of public revenue was effective to foster innovation; and (iv) the lack of transparency of the scheme.
